1. Acceptance of Terms

• Guide2Spalding.com is a community content site for the town of Spalding, Lincolnshire and for the South Holland district. The site includes classified listings, forums and event calendars in which the large majority of the content is provided by the users of Guide2Spalding.com.
• These are the terms of use for Guide2Spalding.com
• By using Guide2Spalding.com you are accepting these terms of use.
• If you do not agree to these terms of use for Guide2Spalding.com your only option is to not use Guide2Spalding.com. Heretofore Guide2Spalding.com will be referred to as “the Service”.

2. Content

• Content refers to: postings, messages, text, files, images, photos or any other material found on the Service.
• Content posted, transmitted through or linked to the Service is the responsibility of those from whom the information originated.
• The Service is not responsible for posted content.
• The Service is not liable for any damages or losses incurred from content made available through the Service.
• The Service reserves the right to refuse, move or delete any content posted on the Service.

3. Notification of Claims of Infringement

• It is forbidden to post information on the Service that violates any international or national ( United Kingdom Emirates) copyright, patent or intellectual property laws.
• The Service is not responsible for any such infringements posted on the site.
• If you are aware of any copyright infringements that have been posted on the Service please contact us at bla@Guide2.co.uk.
• Please include in any such inquiry: the copyrighted material, the infringement, a statement contesting that the copyrighted was not posted by the holder of said copyright, contact details and signature.
• The Service is not compelled to act on any such complaint but may do so out of good faith.

4. Privacy and Information Disclosure

• All personal electronic details will be kept private by the Service except for those that you wish to disclose.
• It is unacceptable to disclose the contact information of others through the Service.
• If you violate the laws of the United Kingdom Emirates and/or the terms of use of the Service you forfeit your privacy rights over your personal information.

5. Conduct

You agree to not post, email, or make available through the Service the following content:

• Unlawful, harmful, threatening, abusive, defamatory, libelous, invasive or any information harmful to minors
• Is of a political nature and/or is critical of any government or municipal employee of the United Kingdom Emirates and/or the Emirate of UK.
• Pornographic or any kind of nudity, sexually explicit or perverse content
• Racist or discriminatory content towards any race, religion, creed, nationality, gender or any other grouping of individuals
• That impersonates another person, which includes but is not limited to: Guide2.co.uk employees, political figures or public figures
• Includes identifying information about another person without permission
• That is false or deceptive
• That infringes on any patent, copyright or intellectual property rights
• That can be classified as: spam, junk mail, chain letters, pyramid schemes, or any unsolicited commercial advertisement
• Solicitation not in the designated area or emailed to a user of the Service who did not wish to be contacted
• Includes links to other websites unless it is: (1) with expressed written permission of the Service (2) in the designated area for services
• That advertises the sale of anything illegal under the laws of the United Kingdom Emirates and the Emirate of UK
• That contains software viruses
• That disrupts the normal flow with an excessive number of messages
• That uses misleading contact details to disguise the origin

You also agree not to:

• Contact people who do not wish to be contacted
• Stalk or harass other users of the Service
• Collect personal information about users for commercial or unlawful purposes
• Use automated means to download data about users unless with expressed written permission from the Service
• Post non-local or irrelevant content
• Post the same service in more than two categories
• Attempt to gain unauthorized access to our server

6. The No Spam Policy

• It is strictly prohibited to contact the Service with unsolicited email advertisements.
• It is strictly prohibited to post spam.
• It is strictly prohibited to contact users of the Service with spam.

7. Limitation on Service

• The Service may establish limits within the site such as but not limited to: length of posting time, size of message, number of postings.
• The Service can limit usage to the Service.
• The Service can delete content and material at any time.
• The Service can change the site at any time.
• The Service is not responsible for any deletion or failure to share of content.

8. Access to Service

• The Service grants a revocable right to use the Service.
• You may not modify any part of the Service or content on the Service other than the content that has originated from you.
• You may not duplicate or use automated means to download from the Service.
• A limited exception is granted to search engines and non-commercial public archives.
• This does not include any sight that participates in classified listing or any subset of classified listings.
• You may create a hyperlink on your website to the Service, or to postings within the Service for non-commercial use.
• You may have a link to our homepage so long as you do not portray the Service or employees of the Service in a misleading light.
• Use of the service beyond said scope will result in the immediate revocation of the right to use the Service.

9. Advertising Terms & Condition

Obligations of the Customer

• To pay the Price on immediate receipt of  invoice from Guide2Spalding and in any event no later than the date on which the Advertisement is to appear on the Web Site, as the case may be. If the Customer is booking advertising through the ecommerce system on the site then the advertisement must be paid before the advertisement is displayed on the site.
• To indemnify Guide2Spalding.com against all losses, costs, claims, damages or other expenses that Guide2Spalding.com incurs as a result of breach by the Customer of any of these terms, or as a result of any third party claims which Guide2Spalding.com receives as a result of the Advertisements.
• To acknowledge that Guide2Spalding.com retains full editorial control over all Advertisements and that Guide2Spalding.com will own all copyright in the Advertisements, save that Guide2Spalding.com shall not own any Customer Branding.
• To provide all materials for the Advertisement (including, without limitation, GIF and JPEG files) in accordance with the procedures required by Guide2Spalding.com from time to time.

Obligations of Guide2Spalding.com

• To use reasonable endeavors to ensure that the Advertisement features on the Web Site for the Duration, or, in the case of Newsletters, on the Release Date, and in each case in accordance with the Special Instructions.
• To use reasonable endeavors to ensure that the Web Site is accessible to users of the world wide web for a minimum of 140 hours each week.
• Guide2Spalding.com does not guarantee any levels of response to the Advertisement.

Rights of Guide2Spalding.com

• The Customer warrants that the Advertisement is not Unacceptable. If Guide2Spalding.com at any time considers that the Advertisement is unacceptable Guide2Spalding.com may remove the Advertisement from the Web Site. In this case Guide2Spalding.com will not refund any part of the Price to the Customer.
• The Customer warrants that the Customer Branding will not infringe the intellectual property rights of any third party.
• Guide2Spalding.com reserves the right to change the format of the Web Site as Guide2Spalding.com sees fit. If Guide2Spalding.com decides to discontinue the Web Site then it will refund to the Customer that proportion of the Price that is equivalent to the proportion of the Duration left to run at the date of discontinuation.
• Guide2Spalding.com reserves the right to terminate this contract with immediate effect by giving written notice of this to the Customer. If Guide2Spalding.com decides to terminate the contract then it will refund to the Customer that proportion of the Price that is equivalent to the proportion of the Duration left to run at the date of discontinuation.

Cancellations

• Cancellations received prior to the Advertisement or a series of Advertisements appearing on the Web Site will be liable for an administrative fee of £25.00.
• No refund or credit will be given for cancellations received after an Advertisement has appeared or after a series of Advertisements has started to appear on the Web and the Customer shall remain liable for the Price in such circumstances.

Liability

• Guide2Spalding.com shall not be liable to the Customer for any indirect or consequential losses or damage suffered by the Customer including (without limitation) any loss of profits, contracts, revenue, goodwill, business, savings or opportunity irrespective of whether Guide2Spalding.com knew or ought to have known of the possibility of that loss.
• Guide2Spalding.com shall not be liable for any losses, damage or expenses (including, without limitation, any costs of finding replacement advertising space) suffered or incurred by the Customer as a result of the Web Site not being accessible to users of the world wide web for any period of time.
• Nothing in these terms and conditions shall operate to limit the liability of either party for any death or personal injury caused by its negligence or that of its employees. In all other events the limit of Guide2Spalding.com 's liability for any losses, expenses or damages incurred by the Customer in relation to this Agreement (whether in tort, contract or otherwise) shall be equal to the Price paid by the Customer to Guide2Spalding.com under this Agreement.
• Guide2Spalding.com shall not be liable for any delay in or non-performance of its obligations under this Agreement to the extent that such delay or non-performance is due to any cause beyond its reasonable control including but not limited to the acts, defaults or omissions of suppliers or sub-contractors, failure of any telecommunications or power network, war, undeclared hostilities, terrorism, industrial action and acts of God.
• Guide2Spalding.com will use reasonable efforts to comply with the Customer's requested start and end dates for display of the Advertisement but cannot warrant that these dates will be met.
